What Happens If I Don’t Have All My Spouse’s Information?

This is completely normal - most people know far less about their spouse’s finances than their own, especially once a relationship has broken down. You can still complete the form and get a meaningful assessment. Here is how it works.

Every question about your spouse is optional

None of the questions about the other party are required. Their income, employment, pensions, and personal circumstances can all be left blank if you simply do not know. Enter what you do know - even partial information helps - and skip the rest.

You may know more than you think. Things worth drawing on include joint bank and mortgage statements, payslips or P60s you have seen during the marriage, their occupation and rough seniority, and any pensions you know they hold - even if you do not know the values.

Estimates are accepted - and better than blanks

Where you do not have a precise figure, a reasonable estimate is fine. If you know your spouse is a teacher with 20 years’ service, or that the house was bought with a joint mortgage, that already tells the assessment a great deal.

The report reflects the quality of the information you provide. Where the picture of your spouse’s finances is thin, the report will be more cautious about that side of the balance sheet - it will not invent figures to fill the gaps.

In real proceedings, both sides must disclose everything

If your case ever goes down the formal route, English and Welsh law requires both parties to give full and frank financial disclosure - usually on a court form called Form E. Hiding assets carries serious consequences, including costs orders and settlements being reopened.
